During mobilization, many citizens are looking for an opportunity to get a deferment, especially those who have good reasons for this. One of these reasons is the maintenance and upbringing of three or more children under the age of 18. This is an important condition that allows you to stay with your family and support your children during difficult times.
Who has the right to a deferment based on the upbringing of three or more children?
According to Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization”, a deferment may be granted to parents or guardians who support and upbring three or more children under the age of 18. It is important that the maintenance includes both material and physical and emotional support, which confirms the fact of active upbringing, education and care of children.
Conditions for obtaining a deferment
In order to receive a deferment on this basis, the applicant must:
- Have no alimony arrears. The law stipulates that parents who have arrears in child support payments exceeding the amount of payments for three months cannot claim a deferment. This requirement was introduced by Law No. 3633-IX of April 11, 2024.
- Provide the necessary documents confirming the status of a parent or guardian and the fact of supporting three or more children.
Required documents for obtaining a deferment
To confirm the right to a deferment based on raising three or more children, the applicant must collect and provide the following documents:
- If the father does not live with the child (children): a court decision on the appointment of alimony, a certificate from the enforcement service on the absence of arrears in alimony, an agreement between the parents on participation in upbringing, a court decision on the maintenance of the child by a conscript, and other supporting documents.
- If the father lives with the child (children), but is divorced from the mother of the children: birth certificates of three or more children, a court decision on divorce with determination of the place of residence of children with the father, or a certificate of a father of many children.
- In case of adopted children: birth certificates, court decision on adoption, marriage certificate confirming the fact of adoption and maintenance of children.
The importance of correct execution of documents
Filing an application for a deferment may require careful attention to each document. For example, if the father does not live with the children, the submission of an agreement on participation in upbringing must be clearly executed. This agreement must specify not only the terms of payment of alimony, but also the procedure for participation in the upbringing and financial support of children.
